What is COMPULSORY PURCHASE ORDER? What does COMPULSORY PURCHASE ORDER mean? COMPULSORY PURCHASE ORDER meaning - COMPULSORY PURCHASE ORDER definition - COMPULSORY PURCHASE ORDER explanation. SUBSCRIBE to our Google Earth flights channel - https://www.youtube.com/channel/UC6UuCPh7GrXznZi0Hz2YQnQ A compulsory purchase order (CPO) is a legal function in the United Kingdom and Ireland that allows certain bodies which need to obtain land or property to do so without the consent of the owner. It may be enforced if a proposed development is considered one for public betterment; for example, when building motorways where a land owner does not want to sell. Similarly, if town councils wish to develop a town centre, they may issue compulsory purchase orders. In Ireland, CPOs became quite common in the early 21st century due to the massive road upgrade programme under the National Development Plan. CPOs are also used for railway projects. If one objects to the issuing of a CPO, one may appeal to the High Court. Compensation is available to ensure that the person is restored, as far as possible, to the same position that they were in before the land and property were compulsorily purchased, so that the person is left in the same financial position after the CPO as they were in before the process. In the United Kingdom, most Orders are made as subordinate legislation under powers given to Local Authorities in existing legislation (e.g. an Order for road works is made under the Highways Act 1980). Whilst the powers are strong, the Authority must demonstrate that the taking of the land is necessary and there is a "compelling case in the public interest". Owners or occupiers can challenge this, and their objection will be heard by an independent Inspector. Compensation rights usually include the value of the property, costs of acquiring and moving to a new property, and sometimes additional payments. Costs of professional advice regarding compensation are usually reimbursed by the Authority, so that people affected by a compulsory purchase order can seek advice from a solicitor and a surveyor and expect to be reimbursed.

Aylesbury Estate: Government blocks compulsory purchase order
A compulsory purchase order to make residents of a London council estate sell their flats ahead of a regeneration scheme has been blocked. The government told Southwark Council it had not done enough to protect Aylesbury Estate residents. Minister Sajid Javid found the orders breached the human rights of residents as they would not be able to afford to stay on the estate or live nearby. Southwark Council said they would seek a judicial review. Read more... http://www.bbc.co.uk/news/uk-england-london-37417949

A Little Help Please...
Eminent domain (United States), compulsory purchase (United Kingdom, New Zealand, Ireland), resumption/compulsory acquisition (Australia), or expropriation (South Africa and Canada) is an action of the state to seize a citizen's private property, expropriate property, or seize a citizen's rights in property with due monetary compensation, but without the owner's consent. The property is taken either for government use or by delegation to third parties who will devote it to public or civic use or, in some cases, economic development. The most common uses of property taken by eminent domain are for public utilities, highways, and railroads;[citation needed] however, it may also be taken for reasons of public safety, such as in the case of Centralia, Pennsylvania. Some jurisdictions require that the government body offer to purchase the property before resorting to the use of eminent domain. The term "eminent domain" was taken from the legal treatise, De Jure Belli et Pacis, written by the Dutch jurist Hugo Grotius in 1625[1], who used the term dominium eminens (Latin for supreme lordship) and described the power as follows: "... The property of subjects is under the eminent domain of the state, so that the state or he who acts for it may use and even alienate and destroy such property, not only in the case of extreme necessity, in which even private persons have a right over the property of others, but for ends of public utility, to which ends those who founded civil society must be supposed to have intended that private ends should give way. But it is to be added that when this is done the state is bound to make good the loss to those who lose their property." Some U.S. states, including New York and Louisiana, use the term appropriation as a synonym for the exercising of eminent domain powers. Condemnation The term "condemnation" is used to describe the formal act of the exercise of the power of eminent domain to transfer title to the property from its private owner to the government. This use of the word should not be confused with its sense of a declaration that property is uninhabitable due to defects. Condemnation via eminent domain indicates the government is taking ownership of the property or some lesser interest in it, such as an easement. After the condemnation action is filed the amount of just compensation is determined. However, in some cases, the property owner challenges the action because the proposed taking is not for "public use", or the condemnor is not authorized to take the subject property, or has not followed the proper substantive or procedural steps as required by law. Other Property The exercise of eminent domain is not limited to real property. Governments may also condemn personal property. Governments can even condemn intangible property such as contract rights, patents, trade secrets, and copyrights. Even the taking of professional sports team's franchise has been held by the California Supreme Court to satisfy the "public use" constitutional limitation, although eventually, that taking was not permitted because it was deemed to violate the interstate commerce clause of the U.S. Constitution.[2]

Homes and Communities Agency v J S Bloor (Wilmslow) Ltd
[2017] UKSC 12 UKSC 2015/0153 Homes and Communities Agency (Respondent) v J S Bloor (Wilmslow) Ltd (Appellant) On appeal from the Court of Appeal (Civil Division) (England and Wales) This appeal relates to a dispute over the amount of compensation the North-West Development Agency should pay the appellant for property which was made subject to a compulsory purchase order as part of a scheme to build a business park in Rochdale. The legal issue is whether, in disregarding the increase or diminution in value of a site acquired compulsorily which is attributable to adjoining land (subject to the same compulsory purchase order), it is permissible to modify the planning status of the site in question. The Supreme Court unanimously allows the appeal.

Private Property and Takings Compensation
BOOK REVIEW PRIVATE PROPERTY AND TAKINGS COMPENSATION Theoretical Framework and Empirical Analysis By Yun-Chien Chang Edward Elgar Publishing Limited ISBN: 978 0 85793 527 4 www.e-elgar.com DOMAIN COMPENSATION -- WELL, COMPULSORY PURCHASE -- ANALYSIS AND SOLUTIONS An appreciation by Phillip Taylor MBE and Elizabeth Taylor of Richmond Green Chambers This book deals for the most part with the relationship between valuations and condemnation values. If you are confused already, what this refers to, as the title indicates, is the compensation arrived at when private property is subjected to being 'taken' by authority of a government, which subsequently compensates the owner financially, at least one jolly well hopes so. We are assuming that this is the same often problematic process that is referred to in the UK as 'compulsory purchase' in which land or property is purchased -- compulsorily -- from an owner to make way for, say, a new road, railway, airport, housing development or whatever, whether the owner likes it or not. From this emerges the knotty problem of evaluation. 'Quick,' says Richard Epstein of New York University, writing in the Foreword, 'what is the present value of your house?' In other words, for what sum should you be compensated if your house is subjected to compulsory purchase? In the UK in recent years we have a kind of Delphic oracle for that: an Internet site called Zoopla -- and there are other sites too, which quite often, apparently know more about your property than you do. However, using examples from both New York and Taiwan, the author Yun-Chien Chang explores and analyses in precise and often technical detail, the methods by which compensation may be arrived at, taking into account, not merely property values, but the complexities of, for example, mortgages, taxation, relocation expenses and so forth. As Epstein quite rightly remarks, '... data from both New York and Taiwan lend solid support to two propositions that we all wish were false: valuations are inaccurate and political influence plays a role throughout the process.' With these dismal thoughts in mind, one might be cheered up a bit by the stringently logical analyses of this and related problems provided throughout this thought-provoking treatise, which is divided into two parts: the theoretical framework and empirical analysis. Part I -- the theoretical framework -- elucidates the three behavioral theories of those government officials charged with the decision making process at the heart of valuation and saddled here, poor souls, with the Harry Potter-esque label of 'condemnors'. Emanating from whatever dense thicket in the groves of Academe, this lovely and very apt term will doubtless become popular in everyday speech, especially among 'condemnees.' -- people who have had anything to do with government officials in a not particularly good way. In all, this is a rigorous and intriguing piece of research, which explores succinctly, yet in detail, the pros and cons of various methods of compensation and offers suggestions aimed at arriving at those solutions which will offer maximum economic value and social benefit. Academics, students and policy-makers, as well as practitioners will find this book eminently useful as a stimulus for engendering further informed debate, certainly on a range of land-use issues which are almost invariably difficult.

The Costs of Estate Regeneration: A Report by Architects for Social Housing
The report on which this film is based can be read on the ASH website at architectsforsocialhousing.wordpress.com. It’s taken considerable research and practical work to produce the figures in this film. The reason for this is that, even though it’s the justification for the demolition of hundreds of London estates and tens of thousands of homes, all this information is withheld by councils under the catch-all of ‘commercial sensitivity’. If you watch this film, you’ll understand exactly why councils won’t let this information out: not to Freedom of Information requests by residents opposing the demolition of their estate; not to Architects for Social Housing when we’ve proposed design alternatives to their demolition; not even to the quantity surveyor representing Aylesbury estate leaseholders at the public inquiry into Southwark council’s compulsory purchase orders on their homes. What this film shows is that the difference between the financial costs of emptying, demolishing and redeveloping estates and the costs of their refurbishment and infill is so enormous that the one or two million pounds our estimates might be out by makes no difference to our arguments for the social, financial and environmental benefits of the latter. We hope that this report will put to bed, once and for all, the widely held but unfounded belief that councils cannot afford to refurbish the estates under their management; that these estates can’t be refurbished sufficiently to redress their managed decline; or that infill development on existing London estates can’t provide the housing we need. As this film demonstrates in considerable detail, all these arguments are fundamentally flawed. In design alternatives to the proposed demolition of six London estates, Architects for Social Housing has shown that refurbishment and – where appropriate and with the collaboration of residents – infill development is the most socially beneficial, environmentally sustainable and financially viable option to address the crisis of housing affordability in the capital. Demolishing and redeveloping estates is not a financial necessity but a political choice, and one that does nothing to address the housing needs of Londoners both present and future. On the contrary, as the figures in this film show, by demolishing our council estates and replacing homes for social rent with so-called ‘affordable’ housing and properties for market sale at upwards of half a million pounds, the estate demolition programme in its current form is expanding the housing crisis at the cost of the increased housing poverty and homelessness of its citizens. One can only imagine what what would happen if this film were broadcast on our national television in place of the poverty porn and stigmatisation of council estates that fill our programme schedules; but in the absence of interest from the British Broadcasting Corporation or anyone else in our Brexit-obsessed media, it’s up to housing campaigners to share this film as widely as possible. At 72 minutes it’s a little longer than we intended, but when it comes to information about estate regeneration the devil is always in the detail, and this film contains the minimum of detail necessary to understand the financial and social costs of this programme and the possibilities and benefits of the alternatives developed by ASH. Please feel free to screen this film to your fellow residents, campaign group, party branch, union members, ward councillor, Member of Parliament, GLA Member, housing association, property developer, regeneration officer, resident engagement panel, steering group, tenants and residents association, community consultancy, architectural practice or anyone else interested in the costs of estate regeneration.

What is Eminent domain? Explain Eminent domain, Define Eminent domain, Meaning of Eminent domain
~~~ Eminent domain ~~~ Title: What is Eminent domain? Explain Eminent domain, Define Eminent domain, Meaning of Eminent domain Created on: 2018-08-16 Source Link: https://en.wikipedia.org/wiki/Eminent_domain ------ Description: Eminent domain , land acquisition , compulsory purchase , resumption , resumption/compulsory acquisition , or expropriation is the power of a state, provincial, or national government to take private property for public use. However, this power can be legislatively delegated by the state to municipalities, government subdivisions, or even to private persons or corporations, when they are authorized by the legislature to exercise the functions of public character.In the Anglo-American historical context, property taken could be used only by the government taking the property in question. The most common uses of property taken by eminent domain have been for roads, government buildings and public utilities. However, in the mid-20th century, a new application of eminent domain was pioneered, in which the government could take the property and transfer it to a private third party. This was initially done only to "blighted" property, on the principle that such properties had a negative impact upon surrounding property owners, but was later expanded to allow the taking of any private property when the new 3rd party owner could develop the property in such a way as to bring in increased tax revenues to the government. Some jurisdictions require that the taker make an offer to purchase the subject property, before resorting to the use of eminent domain. However, once the property is taken and the judgment is final, the condemnor owns it in fee simple, and may put it to uses other than those specified in the eminent domain action. Takings may be of the subject property in its entirety or in part , either quantitatively or qualitatively . ------ To see your favorite topic here, fill out this request form: https://docs.google.com/forms/d/e/1FAIpQLScU0dLbeWsc01IC0AaO8sgaSgxMFtvBL31c_pjnwEZUiq99Fw/viewform ------ Source: Wikipedia.org articles, adapted under https://creativecommons.org/licenses/by-sa/3.0/ license. The Human Misery That Would Be Caused By Leeds NGT Trolleybus
This video was taken at the 11 May 2013 public meeting in Leeds Civic Hall. The clip here shows a lady speaking on behalf of her elderly relative who has already suffered from the the threat of compulsory purchase of her house when the Supertram was mooted some years ago. She moved to West Park, at a loss on the value of her property, to avoid the upheaval, however, she is now again under threat of loss of her garden from compulsory purchase. She is not the only local resident to suffer this threat, which also extends to a large number of gardens, mature trees, grass verges, and even entire houses such as the 200 year old cottage on the corner of Alma Road and a large house on Wood Lane. This lady also argues that the streets of Leeds are not suitable for trolleybuses. After dealing with some other questions Councillor James Lewis's only response to this was that Leeds City Council would use its power of compulsory purchase 'sparingly' and that the process would be brought to a close 'swiftly'. He appears to be quite nervous as he says this. There is much disquiet amongst local residents and others concerned with civil liberties that the draconian measures of compulsory purchase and Transport Works Order would be used to dispossess honest citizens of their homes and gardens, and that a large number of mature trees and grass verges set between houses and the road would be lost. As this lady says, the character of the area would be changed forever. Compulsory purchase is no more than a legal fiction which seeks to make legal, with the stroke of a pen, what in Common Law is simple theft. If even one person is forced to give up their home, or part of their garden then Leeds City Council would be performing a criminal act. The local residents of Headingley, West Park and all the communities along the proposed route would be sacrificed for the convenience of commuters who live outside the area and simply wish to pass through. It is a violation of human rights to carry out the legalised theft which this entails. How can we argue that governments such as those of Brazil or Peru should protect their forests and refrain from dispossessing their indigenous peoples if we here cut down our own mature trees and dispossess our own citizens, many of whom are elderly and having served their communities throughout their lives look forward merely to a quiet retirement, but are instead to be turfed out of their homes or have their gardens taken from them and turned into busy roads with huge vehicles passing? The Third Reich would be proud of such a plan.
Why we must trip up Trump
A short film which presents some of the key reasons to question the proposed Trump Golf development in Aberdeenshire. Tripping Up Trump is one of the campaign groups standing up for the people and environment threatened by Donald Trumps development. This real life story is no longer just about whether you agree or not with the controversial housing and golf complex. This is now about protecting the families that are being threatened by compulsory purchase, not for a school or a hospital but for private profit. The residents of Menie have again and again stated they do not wish to sell and only ask to be left alone in peace but Donald Trump will not accept this fate. Worse still, planning permission was granted on the grounds that he had all the land he needed. This is why Tripping Up Trump will stand strong and protect the residents of Menie from the lurking threat of compulsory purchase. What is happening to the homeowners could happen to anyone else, once a precedent is set. We ask the councillors to immediately take the responsibility to deal with the situation at hand. We need your support to make this happen, spread the word, sign the petition and join the campaign. http://www.trippinguptrump.com
Dulwich Hamlet's Champion Hill could be subject of compulsory purchase order on Tuesday
Dulwich Hamlet could move a step closer to returning to their Champion Hill home at a Southwark Council meeting on Tuesday evening. The council is seeking to impose a compulsory purchase order (CPO) on the home ground of the Bostik League Premier Division club, whose licence to play there was terminated last week by owners Meadow Residential.Champion Hill's future will be discussed at a council meeting on Tuesday when the CPO is likely to be approved. Meadow evicted the seventh-tier club, who regularly attract attendances of over 2,000 to Champion Hill, over what it claimed were repeated breaches of the club's licence.The American property development firm wants to build new housing on the site of Champion Hill, with its plans also seeing a new home for Hamlet constructed on an adjacent site.But those plans have been blocked by Southwark Council, whose leader Peter John has called on Meadow to sell the site - a call backed by Mayor of London, Sadiq Khan.After being locked out of Champion Hill, Dulwich were offered a temporary groundshare by local rivals Tooting & Mitcham in order to see out the 2017-18 season.They play their first game at Tooting's Imperial Fields ground on Tuesday evening, a Velocity Trophy semi-final tie against Met Police, and will be back there for a league game against Worthing on Sunday.Hamlet sit second in the Bostik League Premier Division table, two points behind Folkestone Invicta with two games in hand, but only two points ahead of Billericay who have a further five games to make up on them.
How to Online Virtual Adhaar Number Generate in Bengali | VID Compulsory for Security
official website for Virtual ID VID) Generate- https://uidai.gov.in/ What is VID? Aadhaar virtual ID is a type of tarpary number. This is a 16-digit number. If it is called cloned of the base then it will not be wrong. There will be only a few details in this. UIDAI will give users the opportunity to create a virtual ID of every base. If anyone has to give details of his or her base, then he can give a 16-digit virtual ID instead of a 12 digit base number. The facility of generating virtual IDs will be mandatory In a bid to address privacy concerns, the UIDAI on Wednesday introduced a new concept of 'Virtual ID' which Aadhaar-card+ holder can generate from its website and give for various purposes, including SIM verification, instead of sharing the actual 12-digit biometric ID. This will give the users the option of not sharing their Aadhaar number at the time of authentication. The Virtual ID, which would be a random 16-digit number, together with biometrics of the user would give any authorised agency like a mobile company, limited details like name, address and photograph, which are enough for any verification. Officials said a user can generate as many Virtual IDs as he or she wants. The older ID gets automatically cancelled once a fresh one is generated. The Unique Identification Authority of India + (UIDAI) has also introduced the concept of 'limited KYC' under which it will only provide need-based or limited details of a user to an authorised agency that is providing a particular service, say, a telco. The Virtual ID will be a temporary and revocable 16-digit random number mapped to a person's Aadhaar number and the Aadhaar-issuing body will start accepting it from March 1, 2018. From June 1, 2018 it will be compulsory for all agencies that undertake authentication to accept the Virtual ID from their users. Agencies that do not migrate to the new system to offer this additional option to their users by the stipulated deadline will face financial disincentives. "Aadhaar number holder can use Virtual ID in lieu of Aadhaar number whenever authentication or KYC services are performed. Authentication may be performed using the Virtual ID in a manner similar to using Aadhaar number," a UIDAI circular said. The move aims to strengthen the privacy and security of Aadhaar data and comes amid heightened concerns around the collection and storage of personal and demographic data of individuals. Users can go to the UIDAI website to generate their virtual ID which will be valid for a defined period of time, or till the user decides to change it. They can give this Virtual ID to service agencies along with the fingerprint at the time of authentication. Since the system generated Virtual ID will be mapped to an individual's Aadhaar number itself at the back end, it will do away with the need for the user to share Aadhaar number for authentication.
