It may be enforced if a proposed development is considered one for public betterment; for example, when building motorways where a land owner does not want to sell. Similarly, if town councils wish to develop a town centre, they may issue compulsory purchase orders. In Ireland, CPOs became quite common in the early 21st century due to the massive road upgrade programme under the National Development Plan. CPOs are also used for railway projects. If one objects to the issuing of a CPO, one may appeal to the High Court. Compensation is available to ensure that the person is restored, as far as possible, to the same position that they were in before the land and property were compulsorily purchased, so that the person is left in the same financial position after the CPO as they were in before the process. In the United Kingdom, most Orders are made as subordinate legislation under powers given to Local Authorities in existing legislation (e.g. an Order for road works is made under the Highways Act 1980). Whilst the powers are strong, the Authority must demonstrate that the taking of the land is necessary and there is a "compelling case in the public interest". Owners or occupiers can challenge this, and their objection will be heard by an independent Inspector. Compensation rights usually include the value of the property, costs of acquiring and moving to a new property, and sometimes additional payments. Costs of professional advice regarding compensation are usually reimbursed by the Authority, so that people affected by a compulsory purchase order can seek advice from a solicitor and a surveyor and expect to be reimbursed.

Condemnation via eminent domain indicates the government is taking ownership of the property or some lesser interest in it, such as an easement. After the condemnation action is filed the amount of just compensation is determined. However, in some cases, the property owner challenges the action because the proposed taking is not for "public use", or the condemnor is not authorized to take the subject property, or has not followed the proper substantive or procedural steps as required by law. Other Property The exercise of eminent domain is not limited to real property. Governments may also condemn personal property. Governments can even condemn intangible property such as contract rights, patents, trade secrets, and copyrights. Even the taking of professional sports team's franchise has been held by the California Supreme Court to satisfy the "public use" constitutional limitation, although eventually, that taking was not permitted because it was deemed to violate the interstate commerce clause of the U.S. Constitution.

If you are confused already, what this refers to, as the title indicates, is the compensation arrived at when private property is subjected to being 'taken' by authority of a government, which subsequently compensates the owner financially, at least one jolly well hopes so. We are assuming that this is the same often problematic process that is referred to in the UK as 'compulsory purchase' in which land or property is purchased -- compulsorily -- from an owner to make way for, say, a new road, railway, airport, housing development or whatever, whether the owner likes it or not. From this emerges the knotty problem of evaluation. 'Quick,' says Richard Epstein of New York University, writing in the Foreword, 'what is the present value of your house?' In other words, for what sum should you be compensated if your house is subjected to compulsory purchase? In the UK in recent years we have a kind of Delphic oracle for that: an Internet site called Zoopla -- and there are other sites too, which quite often, apparently know more about your property than you do. However, using examples from both New York and Taiwan, the author Yun-Chien Chang explores and analyses in precise and often technical detail, the methods by which compensation may be arrived at, taking into account, not merely property values, but the complexities of, for example, mortgages, taxation, relocation expenses and so forth. As Epstein quite rightly remarks, '... data from both New York and Taiwan lend solid support to two propositions that we all wish were false: valuations are inaccurate and political influence plays a role throughout the process.' What this film shows is that the difference between the financial costs of emptying, demolishing and redeveloping estates and the costs of their refurbishment and infill is so enormous that the one or two million pounds our estimates might be out by makes no difference to our arguments for the social, financial and environmental benefits of the latter. We hope that this report will put to bed, once and for all, the widely held but unfounded belief that councils cannot afford to refurbish the estates under their management; that these estates can’t be refurbished sufficiently to redress their managed decline; or that infill development on existing London estates can’t provide the housing we need. As this film demonstrates in considerable detail, all these arguments are fundamentally flawed. In design alternatives to the proposed demolition of six London estates, Architects for Social Housing has shown that refurbishment and – where appropriate and with the collaboration of residents – infill development is the most socially beneficial, environmentally sustainable and financially viable option to address the crisis of housing affordability in the capital. Demolishing and redeveloping estates is not a financial necessity but a political choice, and one that does nothing to address the housing needs of Londoners both present and future. On the contrary, as the figures in this film show, by demolishing our council estates and replacing homes for social rent with so-called ‘affordable’ housing and properties for market sale at upwards of half a million pounds, the estate demolition programme in its current form is expanding the housing crisis at the cost of the increased housing poverty and homelessness of its citizens. One can only imagine what what would happen if this film were broadcast on our national television in place of the poverty porn and stigmatisation of council estates that fill our programme schedules; but in the absence of interest from the British Broadcasting Corporation or anyone else in our Brexit-obsessed media, it’s up to housing campaigners to share this film as widely as possible. At 72 minutes it’s a little longer than we intended, but when it comes to information about estate regeneration the devil is always in the detail, and this film contains the minimum of detail necessary to understand the financial and social costs of this programme and the possibilities and benefits of the alternatives developed by ASH. This video was taken at the 11 May 2013 public meeting in Leeds Civic Hall. The clip here shows a lady speaking on behalf of her elderly relative who has already suffered from the the threat of compulsory purchase of her house when the Supertram was mooted some years ago. She moved to West Park, at a loss on the value of her property, to avoid the upheaval, however, she is now again under threat of loss of her garden from compulsory purchase. She is not the only local resident to suffer this threat, which also extends to a large number of gardens, mature trees, grass verges, and even entire houses such as the 200 year old cottage on the corner of Alma Road and a large house on Wood Lane. This lady also argues that the streets of Leeds are not suitable for trolleybuses. After dealing with some other questions Councillor James Lewis's only response to this was that Leeds City Council would use its power of compulsory purchase 'sparingly' and that the process would be brought to a close 'swiftly'. He appears to be quite nervous as he says this. There is much disquiet amongst local residents and others concerned with civil liberties that the draconian measures of compulsory purchase and Transport Works Order would be used to dispossess honest citizens of their homes and gardens, and that a large number of mature trees and grass verges set between houses and the road would be lost. As this lady says, the character of the area would be changed forever. Compulsory purchase is no more than a legal fiction which seeks to make legal, with the stroke of a pen, what in Common Law is simple theft. If even one person is forced to give up their home, or part of their garden then Leeds City Council would be performing a criminal act. The local residents of Headingley, West Park and all the communities along the proposed route would be sacrificed for the convenience of commuters who live outside the area and simply wish to pass through. It is a violation of human rights to carry out the legalised theft which this entails. How can we argue that governments such as those of Brazil or Peru should protect their forests and refrain from dispossessing their indigenous peoples if we here cut down our own mature trees and dispossess our own citizens, many of whom are elderly and having served their communities throughout their lives look forward merely to a quiet retirement, but are instead to be turfed out of their homes or have their gardens taken from them and turned into busy roads with huge vehicles passing? The Third Reich would be proud of such a plan.

Dulwich Hamlet could move a step closer to returning to their Champion Hill home at a Southwark Council meeting on Tuesday evening. The council is seeking to impose a compulsory purchase order (CPO) on the home ground of the Bostik League Premier Division club, whose licence to play there was terminated last week by owners Meadow Residential.Champion Hill's future will be discussed at a council meeting on Tuesday when the CPO is likely to be approved. Meadow evicted the seventh-tier club, who regularly attract attendances of over 2,000 to Champion Hill, over what it claimed were repeated breaches of the club's licence.The American property development firm wants to build new housing on the site of Champion Hill, with its plans also seeing a new home for Hamlet constructed on an adjacent site.But those plans have been blocked by Southwark Council, whose leader Peter John has called on Meadow to sell the site - a call backed by Mayor of London, Sadiq Khan.After being locked out of Champion Hill, Dulwich were offered a temporary groundshare by local rivals Tooting & Mitcham in order to see out the 2017-18 season.They play their first game at Tooting's Imperial Fields ground on Tuesday evening, a Velocity Trophy semi-final tie against Met Police, and will be back there for a league game against Worthing on Sunday.Hamlet sit second in the Bostik League Premier Division table, two points behind Folkestone Invicta with two games in hand, but only two points ahead of Billericay who have a further five games to make up on them.

This will give the users the option of not sharing their Aadhaar number at the time of authentication. The Virtual ID, which would be a random 16-digit number, together with biometrics of the user would give any authorised agency like a mobile company, limited details like name, address and photograph, which are enough for any verification. Officials said a user can generate as many Virtual IDs as he or she wants. The older ID gets automatically cancelled once a fresh one is generated. The Unique Identification Authority of India + (UIDAI) has also introduced the concept of 'limited KYC' under which it will only provide need-based or limited details of a user to an authorised agency that is providing a particular service, say, a telco. The Virtual ID will be a temporary and revocable 16-digit random number mapped to a person's Aadhaar number and the Aadhaar-issuing body will start accepting it from March 1, 2018. From June 1, 2018 it will be compulsory for all agencies that undertake authentication to accept the Virtual ID from their users. Agencies that do not migrate to the new system to offer this additional option to their users by the stipulated deadline will face financial disincentives. "Aadhaar number holder can use Virtual ID in lieu of Aadhaar number whenever authentication or KYC services are performed. Authentication may be performed using the Virtual ID in a manner similar to using Aadhaar number," a UIDAI circular said. The move aims to strengthen the privacy and security of Aadhaar data and comes amid heightened concerns around the collection and storage of personal and demographic data of individuals. Users can go to the UIDAI website to generate their virtual ID which will be valid for a defined period of time, or till the user decides to change it. They can give this Virtual ID to service agencies along with the fingerprint at the time of authentication. Since the system generated Virtual ID will be mapped to an individual's Aadhaar number itself at the back end, it will do away with the need for the user to share Aadhaar number for authentication.
